1 GENERAL CONDITIONS

1.1 The website www.paradice-world.com (hereinafter the “site”) presents a service of the company Paradice Group France, having its registered office in St Lormel, 39 Le Clos Colin, 22130 St Lormel, France registered under number FR50524667128; +33 (0) 77 88 79 313. No guarantee can be offered as to the permanent availability or the proper functioning of this service.
1.2 These General Terms and Conditions of Sale (hereinafter “GTC”) and any individual agreements govern the commercial relations between the company Paradice Group France (hereinafter “Paradice World”) and the customer (hereinafter “you”).
1.3 These terms and conditions apply only between you and Paradice World. They replace all other conditions, unless Paradice World waives them in writing.
1.4 When periods are expressed in working days, the term ‘working day’ means all days of the week except Saturdays, Sundays and public holidays in France.
1.5 Paradice World refers to third party websites through links on its own pages. It is accepted for all these links that: Paradice World has no influence on the presentation or content of the pages to which the links refer. This is why Paradice World expressly disclaims all responsibility for the contents of the pages to which the links refer. This provision applies to all links on the site and to all the contents of the pages to which these links refer.
1.6 By accessing www.Paradice-World.com, you fully subscribe to these Terms and Conditions.

2 ORDER

2.1 The Paradice World online store consists of a simple sales catalogue. By representing products online, Paradice World invites you to view products and/or place orders. The order confirmation sent automatically by e-mail does not constitute a sales contract.
2.2 By submitting your order, you confirm that you have read and accepted the GTC without reservation.
2.3 The contract of sale shall not be deemed effective until the goods have been shipped by Paradice World.
2.4 All data relating to the availability, dispatch or delivery of a product are only provisional data, provided for information purposes. They do not in any way constitute a contractual commitment or guarantee of shipping or delivery time, unless the shipping options for the product concerned specifically state a guaranteed time.
2.5 If Paradice World becomes aware during the processing of your order that the products you have ordered are unavailable, we will notify you immediately. In this case, no contract concerning the unavailable goods shall be deemed to have been concluded because of the absence of dispatch.

3 PRICES AND TAX 

3.1 All prices are given in euro and include value added tax at the legal rate at the time of ordering.
3.2 The minimum order is 10 EURO.
3.3 The shipping costs specified below will be communicated to you separately before the shipment of your order and may vary depending on the desired delivery method.
3.4 Paradice World reserves the right to change its prices at any time. However, the products will be invoiced on the basis of the price in force at the time of the order.
4 PAYMENT

4.1 Paradice World accepts the following payment methods:
• Blue Card

• Apple Pay
• Google Pay
4.2 Payment will only be made if you give permission to the payment interface or PayPal. If payment is refused, Paradice World reserves the right to cancel the order and stop the shipment of the products. If necessary, Paradice World will contact you as soon as possible.
4.3 If you pay by credit card, it will be charged the amount of the ordered products plus shipping costs, 5 working days after confirmation of the order.
4.4 The data entered during the order is transmitted to our partner in encrypted form according to the SSL protocol. You hereby consent to the transmission of the data necessary for the processing of the order to SumUp and PayPal 

5 DELIVERY

5.1 We deliver you to the delivery address you have indicated during the ordering process (home or other). Paradice World does not ensure the marketing and delivery of products outside the geographical areas available at the time of ordering. It is not possible to indicate a post office box for the delivery of orders or to use the “General Delivery” service.
5.2 Delivery Times
The delivery date is determined by the sum of the following 2 elements:
• The preparation time: The deadlines are given as a guide for items available in stock (see below).
• The delivery time of your package by the carrier according to the delivery method chosen by you on the site (see below).


5.3 Delivery methods and costs for metropolitan France, Europe and the rest of the world:

Delivery with Mondial Relais

5.3.1 The average delivery time is 4 to 5 business days depending on the destination. You can always find out the status of your order’s delivery by using the tracking number.
5.3.2 Despite our efforts to ship your order as quickly as possible, it may take 4 to 5 business days before we can deliver the package to Mondial Relais. Thus, you must receive your order 4 to 8 working days after placing it.
5.3.3 You can track your package with the 8-digit shipping number on our Mondial Relay package tracking page. If you do not have the shipping number, you can contact us so that it is communicated to you. In general, you will find your tracking number in your order confirmation email. 

Standard delivery by UPS or DHL

5.3.1 The average delivery time is 48 working hours depending on the destination. You can always find out the status of your order’s delivery by using the tracking number.
5.3.2 Despite our efforts to ship your order as quickly as possible, it may take 4-5 business days before we can hand the package over to UPS or DHL. Thus, you must receive your order 4 to 8 working days after placing it.
5.3.3 The delivery takes place against-signature. If you are absent during the delivery, an InfoNotice notice is placed in your mailbox. In your absence, UPS or DHL may drop the package off at a neighbour’s or another person’s home.
5.3.4 If possible, after a first unsuccessful delivery attempt to your home, UPS or DHL will deliver your package to a relay located near you. If this is the case, you will notice a sticker on the UPS or DHL InfoNotice notice indicating the address and opening times of the relay where you can pick up your parcel within 10 calendar days.

Express Delivery

5.4 The proposed Express delivery is UPS Express or DHL. Delivery fees are charged according to weight and weight volume. Any order placed before 12:30 from Monday to Friday is shipped the same day. Orders placed after 12:30 or during the weekend are shipped the next business day. The delivery is made the day after the shipment and at the latest within 2 to 3 days. UPS Express or DHL deliveries take place Monday to Friday from 9 am to 7 pm at home or at a business address. UPS and DHL cannot schedule a specific delivery time

As soon as the carrier takes charge of your parcel, you can track your parcel at any time on the website using the tracking number of your parcel available on your online account or on your order confirmation email.
The delivery takes place against signature. If possible, after a first unsuccessful delivery attempt to your home, the carrier will deliver your package to a relay located near you. If so, you will notice a sticker on the notice of passage indicating the address and opening times of the relay where you can pick up your parcel within 10 calendar days. In your absence, the carrier may drop the package off with a neighbour or another person at your home.
5.5 Paradice World will endeavour to meet the delivery deadlines indicated. However, Paradice World does not accept any liability in the event of delivery delays, whatever the causes.
5.6 The delivered goods remain the property of Paradice World until full payment of their price.

6 RETURNS

6.1 Right of withdrawal
In accordance with the legal provisions in force (Article L121-20 and following of the Consumer Code), you have a legal period of 14 clear days from the receipt of your products to exercise your right of withdrawal with Paradice World without having to justify reasons or to pay a penalty.
In case of exercise of the right of withdrawal (refund request) within the aforementioned period for the entire order, only the price of the product or products purchased and the initial shipping costs based on the normal UPS rate will be refunded. Return costs remain at your expense.
In case of return of only part of the order, only the price of the purchased product or products will be refunded. The reimbursement of the initial shipping costs is not covered. The return costs remain at your expense.
The refund will be made as soon as possible and at the latest within 30 days on your bank account or PayPal account according to the method of payment chosen at the time of your order.
6.2 Return Procedure

6.3 Paradice World does not cover costs related to returns or exchanges.
6.4 Products may only be returned within 30 days of receipt. 

7 WARRANTY AND LIABILITY

7.1 When you make purchases with Paradice World, and in accordance with the provisions of article L-221-5 of the French Consumer Code, you have 14 days from the delivery date to try your Paradice World items, and you are guaranteed to be able to return them (or exchange them) within this period, without any explanation. After this 14-day period, you can always return your items (excluding exceptions) until they have been worn or washed.
Exceptions:
• Items purchased out of stock cannot be returned.
• Custom items (first names, club, unique model) cannot be returned.

To obtain your refund or exchange, the article must be returned in a state proper to its re-marketing and in its original packaging with all the instructions for use and accessories. It must always have its original barcodes and labels. In case of damaged, worn or returned items without packaging, Paradice World reserves the right to refuse the return of your order.

Returns:
Items purchased at a Paradice World brand reseller store must be returned to the same store. The return time depends on the store.
Please contact the point of sale where the item was purchased for more information.

After verifying that the return conditions are met, the Customer is required to carefully package the returned products in the parcel of his choice, and to ensure that the parcel is properly closed with an adhesive tape.

The Customer is free to use the carrier of his choice.
The postal costs incurred to return the products to the Seller are fully borne by the Customer.

The Seller shall make the refund using the same means of payment as that used by the Customer for the initial transaction, unless the Customer expressly agrees to a different means; in any event, this refund will not incur any costs for the Customer.

The Seller shall reimburse the Customer within two (2) to three (3) days (depending on the banks), upon recovery of the goods by the Seller or upon justification by the Customer of the shipment of these goods, the date chosen being that of the first of these facts.

The withdrawal of the Order by the Customer will only be effectively taken into account provided that the product for which the refund is requested by the Customer from the Seller has been shipped to the Seller within thirty (30) days.

The Seller shall refund to the Customer all sums paid, including the price of the Product or Products subject to the exercise of the right of withdrawal, as well as the amount of the delivery costs of the product or products ordered by the Customer (on the basis of a standard delivery) which is the subject of the withdrawal, if applicable calculated in proportion to the value of the product or products subject to the exercise of the right of withdrawal.

Additional shipping costs related to the customer’s choice of delivery method other than standard delivery will not be refunded.

7.2 Legal guarantees

The buyer has a period of two years from the issue of the property to act; may choose between repair or replacement of the property, subject to the cost conditions provided for in article L. 217-9 of the Consumer Code; is exempted from providing proof of the existence of a defect in conformity of the property during the six months following the issue of the property. 7.3 If the warranty is to be exercised, you are only entitled, during the term of the warranty, to ask us to replace a defective product with a product without a defect of the same value. Any request for additional compensation is excluded.
7.4 Paradice World disclaims all liability in connection with these General Terms and the resulting contractual relations, regardless of the legal reason, to the extent permitted by law.



8 DATA PROTECTION

The special data protection conditions form an integral part of the contract between you and Paradice World. By ordering on the site, you authorise Paradice World to collect and process your data and in particular your personal data as defined in Article 2 of Law No. 78-17 of 6 January 1978 (hereinafter referred to as “Personal Data”).
Your Personal Data collected is the subject of computer processing for the purpose of processing orders or sending promotional emails.
In this context, your Personal Data may be transferred to our service providers, in particular for the processing of orders, located within the European Union but whose branches may be located outside the European Union as well as in the United States-United, Brazil or Singapore.

9 INTELLECTUAL PROPERTY

All texts, comments, descriptions, illustrations and images of the Site are protected by intellectual property law and Paradice World reserves all rights related thereto. Paradice World logo is registered at INPI and EUIPO.

The use or partial or full reproduction of the information, photos, products, design published on this Site is prohibited without the written permission of Paradice World and liable to prosecution.

10 FINAL PROVISIONS

10.1 The site and products have been made in accordance with the provisions of French law. Paradice World disclaims all liability for non-compliance with the legal provisions when using the Site in another country.

10.2 The information on the Site is simply used to illustrate the proposed products and is not contractual. Paradice World is not responsible for any errors or discrepancies.

10.3 Paradice World reserves the right to unilaterally modify these General Terms and Conditions – as long as they form an integral part of the contractual relationship with you – and as long as such modification is necessary to remove imbalances that have arisen subsequently or to an adaptation to any legal or technical conditions that have been modified. Paradice World will notify you of any changes in the content of the amended provisions. Paradice World considers that you accept the changes unless you object in writing within six weeks of receiving the notice of change.

10.4 In the event that isolated provisions of the Contract, including these Terms and Conditions, are found to be partially or fully unenforceable, or if the Contract contains an unforeseen deficiency, the validity of other provisions or parts thereof would not be affected. The legal provisions shall enter into force in place of those provisions which are obsolete or missing.

10.6 The jurisdiction for any dispute arising out of these General Terms and the resulting contractual relations, whatever the legal reason, shall be that of the head office of Paradice World, subject to mandatory jurisdiction imposed by law. Paradice World reserves the right to sue you at your home. This contract is subject to French law in accordance with consumer law. The language of this contract is English.
